Class Action Lawsuit Filed On Behalf Of Volkswagen Owners

Bracamontes & Vlasak, P.C. will be filing a class action on behalf of Volkswagen owners affected by VW’s emission scandal. The EPA and California Air Resources Board have accused Volkswagen of intentionally defrauding both consumers and regulators concerning the amount of pollutants that its diesel powered vehicles emit. Volkswagen is said to have installed software that detects when the vehicle is being tested and, only at that time, activates the car’s emission controls. When the car is operated under normal driving conditions, none of the same emission controls are active. VW is recalling all affected models and the EPA is seeking fines and penalties against the manufacturer.

Volkswagen has increased the number of affected cars worldwide to 11 million. Volkswagen owners that purchased these vehicles generally spent thousands more for the diesel versions than the gas powered models. It is likely that Volkswagen’s fix may affect the performance of the diesel vehicles.

The California Air Resources Board and EPA were alerted about a potential problem concerning Volkswagen’s diesel vehicles in May 2014. After an initial investigation and threatening to refuse issuance of required certificates to Volkswagen did the company finally admit that it had designed and installed a device specifically meant to deceive regulators and the public.

Volkswagen’s CEO, Martin Winterkorn has since resigned as CEO of the embattled company.
