SEVERANCE NEGOTIATIONS

Considerations In Reaching A Severance Agreement

In negotiating severances, there are several factors to consider. Since all severance agreements are voluntary on the part of the employer in the context of at-will employment, what matters most to gain leverage in negotiations is to develop a clear understanding of the strengths and weaknesses of a potential wrongful termination, discrimination, or harassment claim the employee may have against the employer. The next step is to clearly communicate that to the employer along with a reasonable demand, laying out the factual and legal basis of the claim and the concrete risks and consequences to the employer if settlement is not reached.
